Christian Newswire/ -- The Foundation for Moral Law, a Montgomery-based legal foundation dedicated to the defense of the Constitution as written and understood by its Framers and to the right to acknowledge God in the public arena, has filed an
amicus brief with the United States Supreme Court urging the Court to grant a hearing on the case of
Little Sisters of the Poor v. Burwell.
The Affordable Care Act, often called Obamacare, requires most employers to provide insurance for their employees which includes contraception coverage. The Little Sisters of the Poor, a Catholic organization that provides charity to indigent persons, considers that requirement a violation of their Roman Catholic religious beliefs and have sued the Administration seeking an exemption from this requirement. In a 2-1 decision, the U.S. Circuit Court for the Tenth Circuit ruled in favor of the Government, holding that the law did not place a substantial burden upon their free exercise of religion because they could "opt out" by naming another provider for the coverage.
The Little Sisters contend that naming another provider does not relieve the burden on their religious freedom, and they have filed a petition for writ of certiorari, asking the U.S. Supreme Court to hear the case. The Foundation's amicus brief urges the Court to grant that petition and hear the case.
Foundation President Kayla Moore said, "The Little Sisters of the Poor, like the Foundation for Moral Law, believes that life is a gift from God and begins at conception. We join with the Little Sisters in standing against this unconstitutional intrusion on their religious liberty, and we hope the Court will grant their petition."
Foundation Senior Counsel John Eidsmoe added, "The Little Sisters don't just object to paying for this coverage. They believe contraception and abortion violate the laws of God, and they cannot do anything to facilitate these practices. I admire the Little Sisters for resisting this unconstitutional law, and I hope and pray they will stand firm."
