Life Legal Defense Foundation Wants Clinic Already Investigated and Put on Probation to be Shut Down

BIRMINGHAM, Ala., Sept. 19, 2012 /Christian Newswire/ -- An Alabama abortionist is being sued for medical malpractice in civil court action, along with the Planned Parenthood where he works. Accused of a botched abortion, Dr. Aqua Don E. Umoren and Planned Parenthood are on the receiving end of complaints that will be filed by the Life Legal Defense Foundation today. They include a complaint against Planned Parenthood at the Alabama Department of Public Health, and a Freedom of Information Act (FOIA) request to obtain:
- the plan of correction that was supposed to be in place during Planned Parenthood's probation;
- all investigation reports made during the period of Planned Parenthood's probation; and
- proof that Planned Parenthood corrected the deficiencies to justify being removed from probation in light of the botched abortion that occurred during the probation period.
The civil court case, filed by Roberta Clark, whose ectopic pregnancy nearly killed her after medical mishandling by Umoren and Planned Parenthood staff, had records that indicated a completed abortion of an 8-week fetus. That same fetus was discovered over a month later by hospital physicians, at 13 weeks gestation, unaborted, and lodged in Clark's fallopian tube.
Planned Parenthood's yearlong probation was a direct result of exposure coming from a well-publicized investigation conducted by Live Action and reporter Lila Rose. Alabama's health department responded to the independent research with a collaborating finding that the Planned Parenthood's clinic operations were deficient and not in compliance with state laws. In order to settle the dispute, the abortion provider willingly consented to a downgrade of its license rather than face revocation.
"This is just the latest horror story to come to light among Birmingham's abortion providers," said Dana Cody, Executive Director of the Life Legal Defense Foundation, citing the revocation last spring of the New Woman All Women abortion clinic's license after three women were rushed to the emergency room following bungled abortions. Alabama's Department of Public Health revoked NWAW's license to commit abortions after an investigation citing 76 pages of violations and deficiencies, including lack of medical training, absence of medical documentation, the non-existence of safety procedures, and the falsification of patient records.
"Every time a woman is injured or abused by these abortion providers and their wanton disregard for human life, we will be there to fight the legal battle on all fronts," said Cody.
